Early Tenancy Termination

Whilst normally it is rare to have to terminate a tenancy early, we understand that sometimes situations and circumstances can cause your stay with us to need to be cut short of the intended end date.

If you all need to end your tenancy early, this is called a Full Early termination, if only 1 of you needs to end your tenancy early this is called a Partial Early Termination. Both require an addendum confirmed by the named tenants and the Tenants to add to your tenancy agreement to end the fixed-term tenancy at a mutual date.

To advise, your tenancy is a "fixed-term" tenancy, which means in both scenarios of termination, all tenants remain liable for the full rent, bills, and other associated charges under your contract until a 'new' tenancy has signed their agreement and taken over liability for the rest of the tenancy's term.

The process of terminating a tenancy early is outlined briefly below, but importantly do note that it is liable to change depending on an individual case basis and whether it is a Full or Partial Early Termination.

We'll happily talk to the landlord on your behalf, however, if this a multi-person tenancy we ask that you have spoken with the other tenants to make sure all the tenants are on board with the idea first.

If the landlord agrees to your request to terminate early, there would be a charge for amending the Tenancy Agreement at 50% of the rent inclusive of VAT. Once confirmed all tenants would need to sign a "Request to Terminate" letter which we will forward to the Landlord to review on your behalf.

If this is a partial termination (i.e. one or more tenants are remaining at the property), you'll be in charge of finding a new roommate. We suggest the remaining tenant meets any potential new roommates to ensure everyone is happy. If everyone's moving out, don't worry, we can help with finding new tenants.

New tenants will go through the same referencing and guarantor checks you did at the beginning of your tenancy. If they don't meet the criteria, we won't go ahead with their tenancy. Reach out to us for any clarifications on referencing guidelines.

Once we've found replacement tenants and everyone's set to switch tenancies, we'll sort out the paperwork, update the Protected Deposit, do property inspections, and set up a key collection appointment once everything's confirmed.

We will arrange a move-out inspection for the spare room/apartment and confirm if there may be any charges deducted for any tenant(s) who are leaving. Do note that one of the clauses of a Full Early Termination is that all tenants must agree to vacate the premises a minimum 48 hours prior to the end date of tenancy to allow The Agent time to conduct inspections and prepare the property for the replacement tenants. Should the start date of the replacement tenancy fall on a Monday, the tenants will be required to vacate a minimum 48 hours prior to the Friday. i.e If a replacement Tenancy confirms to start 15 August, the tenant should vacate by 12pm 13th August

All tenant(s) will be sent an "Early Termination Addendum Clause" to officially confirm their liability for the contract has ended.

A Tenancy Liability forms will be sent out to the original tenants with final meter readings and list any charges (if any), which all will need to sign and return to us. Once received, we will begin the deposit return process for anyone who has left the tenancy.

Your landlord has the ultimate decision over whether to allow an early termination or not when a fixed-term tenancy is in effect.
