Right to Rent in the UK

Right to Rent requires lettings agents in England to check that all tenants who occupy their properties have legal status to live in the UK. This means that before you can rent a home in England, we must undertake ID checks prior to letting out the property. These checks vary based on whether you have an 'Unlimited' Right to Rent or a 'Limited' Right to Rent in the UK.

When carrying out a Right to Rent check, we must carry out a check on all prospective tenants over the age of 18, even if they are not named on the tenancy by either:

  • Checking an original form of ID (from a list of acceptable identification documents) in person
  • or viewing a tenant’s Right to Rent online via the Home Office ‘share code’ system

Right to Rent for the UK with no restrictions.

If you are a British or Irish citizen or an EU national who has documents to prove your ‘Settled Status’ then you have unlimited Right to Rent in the UK.

For these applicants we must do a physical, original, and valid check on all applicants - to do so all applicants must take steps to come to our offices during this 14-day period with their physical documents for review.

Right to Rent the UK for Overseas Tenants

If you are an overseas national with a Home Office immigration status, you can simply provide a share code along with your date of birth to any letting agent. We will be able to check the Home Office’s real-time system to generate your Right to Rent decision without needing any other documentation. This check needs to be carried out within 28 days prior to the start of the tenancy.

If the Home Office is holding your documents because of an ongoing application or outstanding case/appeal, we can request that they carry out the Right to Rent check. To do this we will need your Home Office reference number to do this.


If you are unable to provide the accepted documents confirming your identity and right to live in the UK then you will not be able to rent property in England.

What if my Time Limited stay in the UK is expiring soon?

If we know your Time Limited stay shall expire during a Tenancy with us, we shall reach out to you to request a new share code. If your documents are with the Home Office we shall conduct a request for them to carry out a Right to Rent Check.

If the follow-up check shows that you no longer have the right to live in the UK, then we must report it to the Home Office.

What documents are acceptable?

Acceptable documents that a tenant can use to demonstrate their identity and Right to Rent are dependent on their nationality.

Options for British citizens are:

  • combination of a valid UK driving license & original UK birth certificate
  • valid passport

Options for all other nationalities are:

  • valid EEA*/Swiss national ID card (after 30th June 2021 a visa or proof of settlement status granted may be required)
  • Share code
